Parts Replacement Guarantee
*A maintenance year includes one A/C maintenance visit, one heating maintenance visit and therefore can not be used for 2 A/C visits, 2 heating visits or in place of a non-maintenance service call
**$55.00 service call fee applies to all non-maintenance visits, no overtime or after hours fees apply, service call is waived if service is needed within 30 days of maintenance visit

****5 YEAR PARTS REPLACMENT GUARANTEE (non-transferable):
We will repair or replace any new component which was installed by Mitchell Cooling + Heating in your existing HVAC system at no charge within five years after the repair as long as the system is covered under a current, paid in full, Residential Mitchell Value Plan maintenance agreement. In cases where the component failure was caused by another problem, all recommendations for repair must also be followed for the warranty to be applied.
Repair workmanship is guaranteed on the installed part only. We do not provide a labor guarantee on parts other than those we install. If repairs later become necessary due to other defective parts, parts and also labor will be charged separately. Repair charges necessary to correct defects discovered by the preventive maintenance inspection will be the sole responsibility of the purchaser and also billed at the discount agreement rate.
Refrigerant leaks are not covered under this guarantee. This agreement shall be null and void if any equipment covered herein has been subject to Acts of God or also conditions beyond the control of Mitchell Cooling + Heating. These include but are not limited to accidents, fire, misuse, improper adjustments, modifications, alteration, tampering, disconnection, vandalism, damage caused by animals, insects or rodents, or failure to properly maintain or also operate the equipment. The parts replacement guarantee will be null and void if more than 30 days occurs with out a current, paid in full, Residential Mitchell Value Plan maintenance agreement. The system must remain in serviceable condition for the parts replacement guarantee to be valid.
This guarantee is effective on all parts replacements and repairs made on or after 01/01/2011 and that are part of a current, paid in full Residential Mitchell Value Plan Maintenance Agreement in effect or purchased as of 01/01/2011. Some new HVAC equipment installed by Mitchell Cooling + Heating may be eligible for up to ten year parts/labor warranty. See your warranty certificates for terms and conditions.
Customer’s right to cancel: Customer may cancel this agreement by mailing a written notice of cancelation to Mitchell Cooling + Heating. A pro-rated refund may be issued, if eligible, for any unused portion
Company’s right to cancel: Company reserves the right to cancel this agreement immediately in the event the system has not been used solely for the purpose under which the condition for which it was designed, has been subject to misuse, neglect, alteration, accident or also abuse, the customer has any portion of the heating/cooling system serviced or replaced by another hvac company, or the customer fails to fulfill the payment terms of the agreement.
Scheduling: All reasonable attempts will be made to schedule your appointments in a timely manner including phone calls, postcards, emails and also letters. If your visit is not scheduled during the appropriate season, you may forfeit that visit for the maintenance year.
Renewal: Renewal notices are sent by mail each year in the spring and also fall. You will receive a proposal to renew in the appropriate season for your agreement. Several reminders will be issued by mail, phone, email or also postcard. It is up to the customer to renew the maintenance agreement in a timely manner to keep all warranties in effect. If after notices are sent, a renewal is not received by the company, the agreement will be canceled and therefore all warranties attached to this agreement will be void.
